Terms of Service
These Terms govern your use of the GoOrLose application and services (the "Service"). By creating an account you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to form a binding contract in your jurisdiction. You must have a valid payment method on file to use Commitment Mode.
2. What GoOrLose does
GoOrLose lets you commit to training days at a chosen gym. When you miss a scheduled day, a penalty you have pre-authorized is charged and contributed to a weekly pool. The pool, minus a service fee, is distributed to users who completed every scheduled day that week.
3. Commitment, penalties & the pool
- You set your own schedule, gym, penalty amount, and daily cutoff.
- A miss occurs when you do not complete a verified check-in before the cutoff on a scheduled day.
- When a miss is confirmed, we charge your primary payment method the penalty amount via Stripe.
- Of each penalty, 10% is retained as a service fee and 90% is placed in that week's pool.
- The pool is divided equally among users who completed every scheduled day that week and who were committed to at least 3 days per week.
- Distributions are credited to your balance on Sunday at midnight local week-start.
- Withdrawals from your balance are subject to the methods and limits shown in-app and may be subject to processing fees or KYC checks.
4. No gambling, no investment
GoOrLose is a behavioral commitment tool, not a game of chance. The outcome depends entirely on your own verifiable actions. It is not a lottery, a wager against other users, or an investment product. We reserve the right to disable the Service in jurisdictions where applicable law would characterize it otherwise.
5. Verification & fair use
You agree not to spoof GPS, use mock-location software, or otherwise misrepresent your presence. We may void check-ins, forfeit pool shares, or suspend accounts that violate this rule. See also the Refund Policy.
6. Disputes & pool access
If you open a payment dispute against GoOrLose for a penalty charge, the Service will automatically and permanently disable Commitment Mode on your account. You will not be charged penalties again, and you will not be eligible to contribute to or receive distributions from the weekly pool. This is not reversible. You can still use the Service for streak tracking and schedule reminders.
7. Health disclaimer
GoOrLose is not medical, fitness, or health advice. Consult a qualified professional before beginning any exercise program. You are solely responsible for your physical safety and for choosing whether it is appropriate for you to attend the gym on a given day.
8. Payments
All payments are processed by Stripe under Stripe's own terms. By providing a payment method you authorize GoOrLose to charge the penalty amount whenever a miss is confirmed, without additional confirmation at the time of charge.
9. Account termination
You may delete your account at any time from Settings. We may suspend or terminate accounts that violate these Terms, attempt fraud, or abuse the Service. Pool contributions already made are non-refundable except where required by law or the Refund Policy.
10. Changes to the service
We may add, modify, or remove features, including pool rules, fees, and distribution logic. Material changes that affect your committed stake will be notified in-app before taking effect.
11. Limitation of liability
To the maximum extent allowed by law, GoOrLose is provided "as is" and we disclaim all implied warranties. Our total liability for any claim arising out of or relating to the Service is capped at the greater of (a) amounts you paid to GoOrLose in the 12 months preceding the claim or (b) USD 50.
12. Governing law
These Terms are governed by the laws of your country of residence to the extent required by local consumer law; otherwise by the laws of [Jurisdiction], excluding its conflict-of-laws rules.
